An Excerpt from Richard Renkin: In my 30 years of experience in family law… I found that most divorces occur because there is an imbalance in power; somebody is dominating somebody in some area whether it is financial which we talked about, whether it is the children which we talked about, whether it is sexual, whether it is drugs, whether it is gambling; somebody, there is not an equilibrium where the parties can move on together so one party pulls away. Well how do you adjust that equilibrium unless you have an organizational structure set up to support the weaker of those two parties and I’m collaboratively trained and I think it is a wonderful process if both people are the same strength emotionally, if they have the same knowledge emotionally, if they don’t see their kids as a weapon or property then this is a great process as is mediation but in the typical case there is so much imbalance of power and imbalance of knowledge and emotional strength that the litigation is necessary really for the weaker party to get strong and for the stronger party to recognize they are not going to get everything they want and for them to move down.
